Ordered That Captain James Nicholson Major Mordecai
Gist and Captain Samuel Smith immediately attend the Council
of Safety at the City of Annapolis, and that the Clerk make
out and deliver to the Messenger separate Copies to be served
on them respectively.
Adjourned till next Day 10 O'Clock.

In Council of Safety. Annapolis Apl 24th 1776.

The examination of Mr William Lux deputy chairman of the
Committee of observation for Balto County.

Q. Who made up and sealed the packet, that was sent to
congress.

A. I did.

Q. Do you know what letters were contained in that Packett.

A. The letter of Ld G: Germaine, letter in Genl Lee's
Hand writing to Jno Hancock, and a private letter to a Gen-
tleman in Philadelphia but does not recollect who. the letter
from the Committee of Safety of Virginia was inclosed in the
Packett to Balto Com"

Q. Was the Packett to J. Hancock very large :

A. No, small.

Q. Did you deliver it to the Messenger:

A. I delivered it to Mr P[urviance] the letr directed to
C[ouncil] of S[afety] was inclosed to us. it had the seal
nearly tore off in opening our letr we desd Gentn appd to wait
on you, to explain the Cause, we went to Mr P. at 1 oClk.
the Gentn who was to go Messr to Phila was in Bed at Mr P.
where we left letr When I recd the packett, I did not open
Genl Lee's letr to Mr P.[urviance]

Q. Did you know of any verbal or written Instns given to
Captn N.

A. No. the 1st I heard of it, was at Annaps

Q. Have not the powers of seizing the Govr been assumed
by persons other than C[ouncil] of S[afety].

A. Not by Commee of obsn for Balto County.

Q. Have they not been assumed (generally)

A. They have.

Q. Have the Commee of Balto any right to accuse C. -S. of
Timidity, inactivity or neglect of Duty.

A. No. the Commee think yr conduct meritorious.

Q. Had Gentn of Balto Commee that were delegated to wait
on us any other commands or instns than the delivery of letr to
C[ouncil] of S[afety],

A. None, they tho' the delegation the most respectful
mode of proceeding.
